Privacy Policy
1. About this draft and the current demo
Birth Injury Helpline (working name) is a public design preview. The current public design demo does not accept, save or submit enquiry details: the case review walkthrough uses fictional, locked example details, submission is disabled, and no analytics, session replay or advertising pixels are included in this preview. Hosting or network providers may process routine access logs, such as IP address and browser details; their actual practices and retention require launch review. The rest of this policy describes proposed practices for a future launch, subject to counsel review.
2. Who we are
Birth Injury Helpline is an informational site illustrating a proposed advertising and enquiry service. It does not currently accept enquiries.
We are an information, advertising and enquiry service, not a law firm. We do not give legal or medical advice, and using the site does not create an attorney-client relationship. This site is attorney advertising.
3. Information we would collect
Information you choose to give us in a case review request:
- who the enquiry is about (a child, or the mother) and your relationship (parent or legal guardian, 18+);
- the state or district where the events happened, and an approximate month and year;
- whether a doctor has mentioned certain conditions, whether there are lasting effects (with a "not sure" option), and an optional short description;
- whether you already have a lawyer;
- your name, phone number, email address and preferred callback time;
- your consent choices, and a record of when and how they were given [LAUNCH: consent-record method to be specified].
Health information. Some answers describe health conditions and are sensitive. We would ask only for the minimum a partner law firm needs to decide whether to contact you. Please do not upload or paste medical records; the initial enquiry does not accept them. [COUNSEL: assess consumer health data laws (for example Washington's My Health My Data Act and similar state laws), state sensitive-data rules and any required separate consent or notice before any health information is collected.]
Technical information. On general content pages, we may use privacy-respecting measurement of page visits and form step completion. [LAUNCH: list tools, cookies and settings.]
4. What we will not put into analytics
- No questionnaire answers, medical details, names, phone numbers or emails are sent to analytics or advertising tools.
- No session replay, heatmaps or advertising pixels on the case review pages.
- Event names and step/status identifiers only (for example "step 3 viewed", "enquiry submitted"); page URLs and query strings must not contain personal or health information.
5. How we would use information
- to pass your enquiry to the partner law firm disclosed to you before you submit;
- to contact you about your enquiry, if you consent;
- to operate, secure and improve the site, using de-identified or aggregate measurement;
- to keep records of consent and opt-outs, and to meet legal obligations;
- to send optional educational updates only if you separately opt in.
6. Who we share it with
- The named partner law firm. Your enquiry is shared only with the law firm identified to you before any future submission, which is identified on the consent screen before you submit. The firm decides independently whether it can help and is responsible for its own handling of your information under its own policies. [COUNSEL: partner data terms.]
- Service providers who host or operate the site for us under contract, only as needed. [LAUNCH: vendor list.]
- Legal reasons, where required by law or to protect rights and safety.
No marketing distribution beyond the firm you choose: we do not intend to pass enquiries to any other firm or marketer, or sell lists of enquiries. The necessary contracted service providers and legal disclosures described above are the only exceptions.
Paid advertising relationship. The partner firm may pay us for advertising or for enquiries. Some US state privacy laws define "sale" or "sharing" broadly, and a paid referral could fall within those definitions. [COUNSEL: determine the statutory classification under each applicable law and whether opt-out links, notices or other mechanisms are required.]
7. Calls, texts and email
If you give consent on the case review form, we and the named partner firm may contact you by phone, text or email about your enquiry, which may include automated technology [COUNSEL: final channel and automation wording]. Consent is not a condition of hiring a lawyer or buying anything. Message and data rates may apply. You can reply STOP to texts to opt out, and you may revoke consent by any reasonable means. [LAUNCH: implement STOP handling, revocation channels and suppression across operator and partner; COUNSEL: TCPA and state telemarketing review.]
Optional educational emails use a separate, unticked checkbox and are never required.
8. Children
The site is for adults. It is not directed to children, and we do not knowingly collect information from children. A parent or legal guardian aged 18 or older may submit an enquiry about a child; the information about the child is provided by that adult. [COUNSEL: COPPA and state minors' data review.]
9. Your privacy rights
Depending on where you live, you may have rights under state privacy laws such as the California Consumer Privacy Act as amended by the CPRA, and comparable laws in states including Virginia, Colorado, Connecticut and others. These may include rights to know or access, correct, delete, obtain a copy, opt out of sale, sharing or targeted advertising, and limit use of sensitive information, and to not be discriminated against for using them. Whether a law applies varies with the law, the business's activities, thresholds and exemptions; some consumer health data duties can apply outside the thresholds of general state privacy laws. [COUNSEL: confirm which laws apply to the operator, including consumer health data laws. COUNSEL/LAUNCH review items, not implemented: request method and verification, appeal process where required, authorized agent requests, and honoring recognized opt-out preference signals such as Global Privacy Control.]
A privacy-rights request process must be established before real intake is enabled.
10. Retention
We would keep enquiry and consent records only as long as needed for the purposes above and legal obligations. [LAUNCH/COUNSEL: specific retention schedule.]
11. Security
[LAUNCH: describe the actual safeguards once implemented.] No method of transmission or storage is completely secure.
12. Changes
We will update this policy and its effective date if our practices change.
13. Contact
Enquiry and privacy request contact facilities are not available in this demonstration. They must be established before real intake is enabled.
